Fadzai Mahere, one of opposition leader Nelson Chamisa’s loyalists, has emerged victorious in a court appeal, successfully overturning both her conviction and sentencing. This victory comes as a result of her unwavering loyalty to Chamisa, demonstrated by her resignation from Parliament shortly after Chamisa withdrew from the opposition movement.
The High Court ruling on Wednesday saw the conviction and sentence of the former Mount Pleasant MP and lawyer being overturned. Justice Benjamin Chikowero and Justice Pisirayi Kwenda determined that Mahere had been charged, tried, and convicted under a nonexistent law. As a result, they upheld her appeal and nullified the conviction and sentence.
Back in April 2023, Mahere had been fined US$500 or faced three months imprisonment after being convicted of undermining public confidence in a law enforcement agency, specifically the Prison Service or the Defence Forces of Zimbabwe. The charges stemmed from an incident in January 2021 when Mahere was arrested by the police for allegedly publishing or communicating a false statement with the intent of inciting public disorder or violence, endangering public safety. Prosecutors claimed that Mahere had shared a message on a social media platform alleging that a ZRP officer had fatally beaten a baby strapped to its mother’s back—a claim deemed false by authorities.
The Zimbabwe Lawyers for Human Rights (ZLHR) played a crucial role in advocating for Mahere’s case and ensuring that justice was served. Their efforts helped bring to light the unjust application of a nonexistent law in Mahere’s conviction, leading to the successful appeal.
