Controversial city lawyer Male Mabirizi has been summoned by the criminal investigations department (CID) to appear before the police in relation to his recent bigamy case against Busoga king William Nadiope. However, Mabirizi has expressed his intention to defy the summons, citing that the takeover of his criminal case by Jinja resident state attorney was premature and unconstitutional, and thus he will not attend.
Mabirizi’s case stems from his private prosecutions against Kyabazinga, his wife Jovia Mutesi, and some individuals who witnessed his wedding on November 18, 2023. According to Mabirizi, on that date, at the Christ Cathedral Bugembe, Nadiope, Mutesi, Archbishop of Church of Uganda Stephen Kazimba Mugalu, and Buganda kingdom queen Sylvia Nagginda participated in and officiated a marriage ceremony, fully aware that it was invalid, criminal, and void. This is because Nadiope had reportedly previously married Alison Anna in December 2016 in England.
Mabirizi has levied different charges, including fictitious marriage, bigamy, marriage with a person previously married, unlawfully performing a marriage ceremony, and conspiracy to commit felonies against Kazimba and Nagginda. He has requested criminal summons to be issued against the listed individuals, calling for them to appear in court, have the charges read to them, be convicted, and sent to prison to serve their respective sentences. The director of public prosecutions (DPP) has since taken over the criminal proceedings of the case.
In response, the police have issued a summon for Male Mabirizi to report to Kira Central Division – Jinja Central police station to the office of the Divisional CID. Mabirizi is required to report to Detective Assistant Superintendent of Police Evelyn Anyango on Tuesday, the 13th of February 2014 at 1100 hours.
As the situation unfolds, Mabirizi remains steadfast in his decision not to attend the summons, asserting that he believes the takeover of his criminal case and the summon by the police were premature and unconstitutional. He is confident that these issues will be set aside, and he will not comply with the summons.
