The state of governance in our country is far from ideal; it may even be described as a dystopian landscape, characterized by broken dreams and missed opportunities. We are currently bearing the heavy burden of past corruption and simultaneously sowing the seeds of future turmoil. This has led to a desperate and relentless struggle to evade and mitigate the consequences of past wrongs, while also engaging in present misconduct that will punish future generations.
The collapse of high-rise buildings and devastating fires have become unfortunate occurrences in our society. The Ndung’u Report has documented the misconduct of public officials who have conspired to privatize public roads, deny urban dwellers essential amenities, and turn our urban areas into dangerous slums. This has resulted in a lack of proper infrastructure and safety measures in the midst of teeming, malodorous slums.
Thoroughfares in these areas have become nothing more than crowded paths, cluttered with informal shacks, makeshift stalls, and unlicensed establishments, creating a chaotic and unsafe environment. The chaotic nature of these areas is a reflection of the corruption that has led to illegal land grabbing and the subsequent lack of urban development planning.
The lack of formal regulations and institutions in these areas has led to the existence of unlicensed and unregulated enterprises, creating an environment in which the public is exposed to multiple dangers without any hope of protection. Failure of governance and regulation in these areas has led to numerous disastrous events and catastrophic failures.
The root cause of governance and regulatory failure is traced back to the negligence of our independence generation and subsequent leaders to decolonize Kenya after attaining independence. This neglect allowed governance to be influenced by the predatory state mentality, resulting in a lack of trust between the citizenry and the state.
The failure to adequately decolonize the state and educate the elite on the dangers of impunity has set the country on a path of destruction and conflict. The lack of trust between the public and the state has led to a society plagued by road accidents, collapsed buildings, and explosions, highlighting the intense conflict within the soul of our republic.
In conclusion, it is evident that the failures of governance and regulation in our country have led to a myriad of detrimental consequences. It is imperative that we address the root causes of these failures and work towards rebuilding trust and ensuring the safety and well-being of our citizens.
As an Advocate of the High Court, it is essential to acknowledge and work towards rectifying the systemic issues that are plaguing our nation and undermining the safety and security of its people.
