Kenya: Three charged with vandalising Sh9m drainage covers to sell as scrap metal

Three men, Josphat Mutinda Mutua, Samson Gatimu, and Robert Kinyua, have been charged with sabotaging and endangering the lives of the public in Eastleigh, Nairobi County. They are accused of unlawfully destroying metal covers used by the Kenya Urban Roads Authority (Kura) to cover the drainage system along General Waruinge Road, resulting in damage estimated at Sh9.3 million.

The suspects were apprehended by Nairobi County Government enforcement officers on the night of January 16, 2024, while they were in the process of removing the metal covers. According to court documents, the men had been damaging the covers between November 1, 2023, and January 16, 2024, with the intent to endanger the lives of members of the community.

During a routine patrol, the county government officials caught the suspects in the act, leading to their arrest. They were found in possession of over 200 cover slabs, and upon further investigation, 300 more covers were recovered from a kiosk where they had been stored.

The suspects appeared before Senior Principal Magistrate Justus Kituku of the Makadara Law Courts and denied the charges. They were released on Sh1 million bond each, with an alternative cash bail of Sh500,000. The case is scheduled for mention on March 20, with the hearing set to begin on June 17, 2024.

The destruction of drainage covers not only causes financial loss but also poses a threat to the safety of pedestrians and motorists. It is a serious offense that endangers the lives of the public and disrupts the infrastructure. The legal process will determine the consequences for these actions and serve justice for the potential endangerment of the community.
