The Western Cape High Court recently ruled that the conduct of billionaire golf course owner Hasso Plattner at Fancourt was unsportsmanlike when he terminated the memberships of residents Brian Buckham, John Millar, and Warren Erfman, who had snubbed him. Plattner, the German founder of SAP, was ordered to reinstate their memberships immediately, as they had been members of The Links Golf course for between 10 and 20 years. The matter was referred to the high court for arbitration after attempts to settle the dispute failed.

Judge Derek Wille, in his ruling on 1 March 2024, emphasized that golf is a game of honesty and integrity, and this principle should also apply to the management of golf clubs. Fancourt, known for its courses designed by Gary Player and its stunning location on the Garden Route with views of the Outeniqua mountains, is home to three championship golf courses, including The Links, which is ranked as one of the top courses in the country. The prestigious club has hosted events like the 2003 Presidents Cup matches.

Plattner, a passionate yachtsman and golfer, also owns the Cordevalle Golf Club in California. In 2015, he established the Hasso Plattner Foundation, which aims to promote the adoption of digital technologies through art and culture. He is also involved in philanthropic programs, having donated to HIV/AIDS awareness programs and organizing benefit concerts.

The court found that the residents had complied with all membership requirements and had not violated any rules or codes of conduct. The exclusivity of the club and the strict rules that members must adhere to were emphasized in the ruling. Plattner’s attempt to terminate the memberships based on his perception of the residents’ behavior was deemed unjustifiable by the court.

The homeowners association, which represents the communal interests of property owners at Fancourt, had taken legal action against Plattner for revoking the memberships of the three residents, who were directors of the association. Plattner’s actions were seen as biased and unjust, as the residents were not given a fair hearing or the opportunity to present their case.

The judge criticized Plattner for pre-judging the matter and acting in a biased manner, which violated the principles of justice. It was emphasized that decisions by private entities must follow fair procedures and allow individuals to present their evidence. The court’s ruling to reinstate the residents’ memberships was seen as a necessary measure to uphold fairness and prevent arbitrary decisions that could have significant effects on third parties.
