The general prosecutor requested the judge to declare the petition on excess of power inadmissible. “Knowing that the declaration of inadmissibility of the petition on excess of power implies that the interim relief is also to be declared inadmissible. I ask that the latter be also declared inadmissible.”
The Prosecutor General takes the floor for his indictment. He asserts that the two petitions submitted to the Court have the same purpose, which is to suspend the decree setting the presidential election date. “So, as decided at the beginning of the hearing by the President of the Court, I agree to merge the two petitions.”
However, the representative of the public ministry still mentions that there is a lot of anticipation in this case.
“What I did not know about legal practitioners is their expertise in meteorological matters. There are elements of contradictions that need to be noted. One of the first aspects to highlight is that the lawyers must stick to the conclusions of the public ministry. After rereading the petitions, all the questions raised about competence are unfounded. One of the petitions was signed by the parties, which goes beyond admissibility. I could add these elements of contradictions that are mentioned to defend this petition, not to defend the decisions of the Constitutional Council because one of the petitions from the lawyers contains acts that target the elements of constitutionality and the Constitution. These two are intrinsically linked.”
