Senegal: “Samba Sy refuses to comply with the Supreme Court decision – Africa Links 24”

The Supreme Court, ruling on the appeal filed on March 17, 2023 by the Syndicat des enseignants libres du Sénégal/Authentique (SELS/A), annulled the decree of the Minister of Labour, Social Dialogue and Relations with Institutions, Samba Sy, dated April 12, proclaiming the final results of the trade union representativity elections in the public Education and Training sector.

The highest court reproaches the Minister for deliberating while an appeal against the results in question was pending at the Court of Appeal.

Therefore, after receiving notification of the court’s decision, the plaintiff invited the opposing party to “promptly organize new elections to allow teachers to choose their representatives at the official negotiation and consultation table.”

However, Samba Sy refuses to comply. Standing firm, the Minister states that the department he leads “having not been informed of any annulment appeal filed at the Court of Appeal, published on April 12, 2023, a decree proclaiming the final results in accordance with the decree establishing the rules for organizing trade union representativity elections…”

In a statement, he further emphasizes that by “annulling the decree proclaiming the final results solely on the grounds that all recourse avenues have not been exhausted, the Supreme Court has not questioned the election results.”

The overseeing authority therefore awaits the Court of Appeal to settle the annulment appeal filed by the aforementioned union “to determine whether the provisional results will be confirmed or not.”
