President Macky SALL, You are no longer bound by Article LO 137 of the Electoral Code. You have already complied with it through Decree 2023-2283 convening the electoral body. You may have forgotten that the Constitutional Council annulled your decree repealing this decree for illegality. You have been in illegality up to this day. The new decree to be issued is no longer bound by the obligations of Article LO 137 of the Electoral Code.
If that were the case, the Council would have told you to respect the provisions of Article LO 137 instead of “as soon as possible.” What is stopping you from holding the election before April 2nd? Do you want to pass other laws for the statute of limitations for financial crimes? Have you forgotten that laws passed today can be repealed tomorrow? The law can do everything except turn a man into a woman and vice versa.
If your intention is to resume the electoral process, it is a lost cause. The Constitutional Council has already blocked your path. Re-read the decision of February 20, 2024 from the CC after the withdrawal of Rose Wardini’s candidacy. There is no reference to your decrees in the recitals. There is also no mention of the election date. In Article 4 of this decision, the Council decided that “the final list of candidates for the presidential election is as follows…”. Unless there are new withdrawals or the death of a candidate, this list cannot be revised.
More than ever, the days are numbered. The end of your term is approaching.
