Receiving the conclusions of the national dialogue on Monday, Macky Sall mentioned the date of the Presidential election, which could be set for June 2nd if the Constitutional Council validates the request of the dialogue participants. If this date was chosen instead of a closer date to the end of the mandate (April 2nd), it is out of respect for Article LO 137 of the Electoral Code, as Macky Sall explained. “It was essential that we return to the legal foundations of an election. An election cannot be organized disregarding the provisions of the electoral code that govern the process. The first requirement when talking about the electoral college is the provisions of Article LO 137: the necessity of having 80 days between the decree date and the Presidential election,” said the head of state. Indeed, Article LO 137 of the Electoral Code states: “Voters are convened by decree published in the Official Journal at least eighty (80) days before the date of the election. In the event of a second round, or a new round of voting after the annulment of the election, the publication of the convocation decree takes place no later than eight (8) days before the election date. However, in case of vacancy of the Presidency, by resignation, permanent impediment or death, the decree is issued within sixty (60) days before the election.” Taking into account this article, if June 2nd is chosen as the date for the Presidential election, Macky Sall is obligated to publish his decree within 10 days, by no later than Thursday, March 14th, 2024, coinciding with the 80th day before June 2nd.
