In a decree signed on March 1, 2024, President Macky Sall ordered the presentation of a bill granting amnesty to the National Assembly. The Minister of Justice is responsible for presenting the reasons for the bill and supporting its discussion.

In the statement of reasons, the Head of State recalls his intention to “calm the political and social climate,” strengthen “national cohesion,” and consolidate “national dialogue,” in order to allow certain individuals who have had conflicts with the law to fully participate in democratic life.

With this act, the President intends to continue the implementation of measures to reduce tension, beyond the right of pardon granted to him by the Constitution.

It is also noted in the document that “some legal proceedings have resulted in convictions that have led to incapacities and disqualifications related to voting and election rights. It is in this spirit that the present bill grants amnesty for offenses committed both in Senegal and abroad, covering a period from 2021 to 2024.”

According to the document, the amnesty covers “all acts, which could be classified as criminal or correctional offenses, committed between February 1, 2021, and February 25, 2024, in Senegal or abroad, relating to demonstrations or having political motivations, including those made through any form of communication, whether the perpetrators have been judged or not.”

The decree emphasizes that “physical restraint cannot be exercised against convicted individuals who have benefited from amnesty, except at the request of the victims of the offense or their heirs.”

However, court judgments or rulings, as well as decrees, orders, and decisions made in the context of public service or national orders, are not subject to this prohibition when they have been deposited in the courts or in the National Archives.
