Habib Sy is contesting the date of March 24th announced by the President of the Republic as the day of the presidential election. He announced on the airwaves of RFM that he will contact the other candidates to challenge the date announced by Macky Sall, which is Sunday, March 24, 2024. According to the presidential candidate, the only valid date remains March 31, 2024.
“The Constitutional Council has been very clear. It has set the date of March 31 and has even convened the electoral body. It went further. It took all its responsibilities so that we can quickly have free, democratic, and transparent elections,” explained Habib Sy.
By setting the date of March 24, he says, the “President of the Republic is fully aware that he is violating the provisions of the electoral code and also that it is a decision contrary to the decision of the Constitutional Council. This cannot be done.”
“If this decree is published,” continued the candidate, “I will quickly ask the other candidates to challenge this decree because it will be taken in violation of all legislative and regulatory provisions related to elections.”
According to the former minister, there must be 21 days of campaigning as set by the electoral code. “For March 31, we will have 21 days of campaigning. While with March 24, we have only 17 or 18 days at most. We must stick to what the Constitutional Council has said, and I believe that this is what is obligatory for us candidates and also for the President of the Republic,” indicated the president of the Yewwi Askan Wi leaders’ conference. Habib Sy invites President Macky Sall to organize the elections as quickly as possible.
It should be noted that the Constitutional Council specified in its decision n°6/E/2024 of March 6, 2024, that it exercised these prerogatives “by substitution, under its regulatory power,” in order to “remedy the inertia of the Administration” and “meet the constitutional requirement for the resumption of the interrupted electoral process.”
This intervention aims to ensure the holding of the election before the end of the current presidential term. The Council confirmed on Thursday, March 7, 2024, that the presidential decrees are in accordance with this constitutional requirement.
