The Head of State has declared that he does not intend to continue his term after it expires. President Alassane Ouattara gave him advice in this direction.
Macky Sall insisted that he will leave his position on April 2, the date his term expires. He discussed this with his Ivorian counterpart, and Alassane Ouattara notably recommended that he step down from power at the end of his term, as reported by Africaintelligence.
What will happen on April 2 if a new president is not elected?
It is still unknown who will lead the country after Mr. Sall’s term expires. “We cannot leave the country without a President, it is not possible,” he said. According to Article 36 of the Senegalese Constitution, it states that: “The elected President of the Republic takes office after the final proclamation of his election and the expiration of the term of his predecessor. The incumbent President of the Republic remains in office until the installation of his successor.”
According to constitutionalist Babacar Gueye, an election after this date will result in “a situation of legal vacuum.” Although, according to Article 39 of the Constitution, in case of resignation, impediment, or death, the president is replaced by the president of the National Assembly, nothing is mentioned about the current scenario.
Thus, in such circumstances, the only option left is the Constitutional Council. The latter could either ask the president of the Assembly to ensure interim and organize an election within a specified timeframe, or call on the political class to find a solution, according to Babacar Gueye.
It is worth mentioning that the Presidential election in Senegal is set to take place on Sunday, March 24, 2024, as decided by President Macky Sall.
