Amadou Madiop Seck, residing in Rufisque, was brought before the Dakar court of flagrant offenses on Tuesday, February 27, 2024 for fraud involving an amount of 7 million CFA francs to the detriment of Ms. Maïmouna Dior Fall for a vehicle purchase.

It appears from the facts that the defendant led Ms. Maïmouna D. Fall to believe that he owned a vehicle parking lot. In reality, the lady saw a post by the defendant selling a car on Facebook for 7 million CFA francs. Interested in the car, she approached him. After discussion, the plaintiff handed him the amount in exchange for the car she never received.

With ill intentions, Amadou M. Seck flew to Morocco, convincing the lady that he had gone to Gambia to settle the car. Subsequently, he became unreachable for 3 years. But as the saying goes, no crime is ever perfect. He was deported from the Kingdom of Morocco. Upon his return to Senegal, he changed address and phone number. However, he was eventually apprehended by the investigative section.

Before the court, the accused Amadou M. Seck admitted to the charges against him. He claims that he had posted the car, and she had said she wanted a different car. “It was at this point that I found the car she wanted, but the seller was in Gambia. The other fact is that the car was not in good condition because there was a problem with the engine,” he explained in court.

He added that for this car, he was only supposed to receive a small commission of 500,000 CFA francs.

The civil party, represented by Me Abdou Ngingue, points out that there were maneuvers at the base of the case. His client received a sum of 4 million, and the rest (3 million), he promised to pay upon his arraignment.

Speaking, the prosecution reminded him that he had told the civil party that he had a parking lot and was in import-export, which was completely untrue. As a result, in its requisition, the prosecution mentioned that the defendant admitted to the charges and requested a sentence of 6 months, including 3 months of imprisonment.

On the defense side, it claims that there was no fraudulent maneuvering and requests a very lenient application of criminal law.

Ultimately, the court, after deliberation in accordance with the law, found him guilty and postponed the sentencing before lifting the arrest warrant and urging him to pay the 3 million CFA francs.
