Probe into Kagezi murder case complete, says DPP

Investigations into the murder of former prosecutor Joan Namazzi Kagezi have been completed, as confirmed by the Director of Public Prosecutions (DPP) in court. Assistant Director of Public Prosecutions Thomas Jatiko informed the Chief Magistrates Court at Nakawa that the investigations into the case of terrorism and murder involving four accused individuals had been finalized.

During the court session, Jatiko stated, “A summary of the case has been prepared. So, I pray this court should issue a production warrant for purposes of having them committed to stand trial in the High Court Criminal Division.” This plea was made on Monday, emphasizing the readiness of the prosecution to proceed with the case.

The four accused individuals, namely John Massajjage alias Mubiru Brian alias Badru alias Chongo, Nasur Abdallah Mugonole, John Kibuuka alias Musa, and Daniel Kisekka Kiwanuka, have been in custody since their arrest in an intelligence-led operation. They are currently held at different prisons including Jinja Main Prison, Kitalya Mini Max Prison, Luzira Murchison Bay Prison, and Kigo Prison.

The DPP has gathered and compiled evidence against the suspects, indicating her intention to prosecute them in the case. The prosecution’s submission led Chief Magistrate Erias Kakooza to issue a production warrant, mandating the prison authorities to present the four suspects on March 6, 2024, for further proceedings.

The charges against the suspects include terrorism and murder, stemming from an incident on March 30, 2015. The state alleges that the accused individuals engaged in an attack resulting in the murder of Assistant Director of Public Prosecutions Kagezi with the aim of influencing the government or intimidating the public for social or economic purposes.

According to the charge sheet signed by DPP Jane Frances Abodo, the state contends that the four accused individuals deliberately caused the death of Kagezi. The tragic event took place on the evening of March 30, 2015, in Kiwatule, a suburb of Kampala, where Kagezi was fatally shot in her vehicle in front of her children.

Additionally, the court has postponed a case involving suspected Allied Democratic Forces (ADF) rebel group commander Abdul Rashid aka Njovu. The charges in this case revolve around the killing of a foreign honeymoon couple and their Ugandan tour guide, David James Barlow, Ceyer Emmarentia Cecilia, and Eric Alyai, respectively. The incident occurred on October 17, 2023, in Queen Elizabeth National Park in Kasese District, where the victims were attacked, robbed, and their car was set on fire.

The court session in both cases highlights the ongoing efforts to seek justice for the victims and bring those responsible to account for their actions. The legal proceedings demonstrate the commitment of the authorities to uphold the rule of law and ensure that perpetrators of heinous crimes are held accountable for their deeds.
