Kenya: Pastor Mackenzie pleads for mercy, deems 191 murder charges ‘overbearing’

Controversial preacher Paul Mackenzie and 29 co-accused complain about oppression and Attorney James Mouko claims number of charges is oppressive and violates constitutional rights of accused. It is evident, that 191 charges are excessive, as no more than 12 counts be contained in a single charge sheet. Also, the charge sheet was defective in several respects. The case, against controlling the investigation, will be heard, and fair hearing conditions will be put to use in the Constitution of Kenya and other constitutional provisions.

As suspected by many, Mackenzie and his group were believed to be responsible for the murders of 191 children in Kilifi’s Shakahola Forest in a deadly fast that also led to the death of 429 of his followers. The prosecution identified many of the children, although it only has 80 victims identified. The charge sheet reads that Mackenzie conspired to kill Natha Mathu, Evadra Dito, Seth Ngala, Sifa Edison and 187 other children in the Shakahola area of Kilifi County. All named suspects denied the incrimination before Justice Thande although a psychiatric report justifying them to stand trial has given everyone clearheadedness except Evans Kolombo who is still being treated.

Evans Kolombo, seen as a critical figure alongside Mackenzie, is currently unable to walk on account of paralysis. He was in good health upon arrest, and Kolombo’s lawyers claim ignorance of any mental health problems occurring alongside his paralysis. They propose waiting to find out about a mental illness. The prosecution asked the court for time to address everything thoroughly.

The prosecution also expresses concern about Mackenzie’s transfer to the Malindi GK Prison, proposing that it would be administrative trouble to relocate him from Shimo La Tewa Prison. They are also opposed to Mackenzie’s release on bail. This was also postponed by Justice Thande, and any attempt to release Mackenzie on bail will be opposed.

At the same court session, the only two women charged with murder, Mary Kadzo Kahindi and Anne Anyoso, pleaded with the court to direct the prison authorities to help them shave their heads. Kadzo Kahindi and Anne Anyoso want to shave their heads but have not been able to. Justice Thande granted the women’s request, also ensuring their personal belongings taken from the suspects and kept in Kilifi prisons be returned to them.

These cases are set for a mention on March 7th as parties are preparing and exchanging their documents before two applications are heard. The prosecution does not oppose the request of the appropriate authorities to allow all suspects to take care of themselves through meeting with their lawyers.
