A Federal High Court in Kano has made a decision to void the suspension of the National Chairman of the All Progressives Congress, APC, Abdullahi Ganduje, that was imposed by his ward executives. This ruling was made shortly after a state High Court, which has coordinate jurisdiction, confirmed Mr. Ganduje’s suspension. Despite the order from the Kano High Court, Mr. Ganduje took legal action by filing an ex parte motion to enforce his fundamental right to fair hearing.
The respondents in this application include the Police, State Security Service, SSS, Nigeria Security and Civil Defence Corps, NSCDC, and nine other individuals. It was reported that on April 16, the APC executives in Ganduje Ward of Dawakin Tofa Local Government Area announced the suspension of the former governor due to allegations of corruption. Following this suspension, the State Working Committee of the APC in Kano declared the suspension null and void, expressing their intention to take legal action against the ward executives responsible for the suspension.
A Kano High Court presided over by Justice Usman Na’Abba upheld the suspension on Wednesday. However, in a recent ex parte order granted on Thursday by Justice A.M Liman of the Federal High Court, the state High Court’s decision was disregarded. The Federal High Court ruled that the purported suspension should not be implemented until the case is heard and determined.
Justice Liman stated, “That all the Respondents, their servants, agents or privies are hereby restrained from Implementing and/or giving effect to the purported decision reached during the purported emergency meeting of the alleged Executive members of APC Ganduje Ward, held at Ganduje Ward of Dawakin Tofa Local.” The court also mandated all parties to maintain the status quo before the emergency meeting of the alleged executive members of APC Ganduje Ward, and to refrain from taking any action in relation to the matter until the substantive application is heard and determined.
The Federal High Court has scheduled April 30 for the continuation of the case. This legal battle highlights the internal turmoil within the APC in Kano and the conflicting decisions from different courts. The outcome of this case will have significant implications for the future leadership and stability of the party in the state.
