The Mapo Grade A Customary Court in Ibadan recently dissolved the 14-year marriage of John Akinwumi, a commercial driver, and his estranged wife, Toyin. Akinwumi sought the dissolution of the marriage citing constant domestic violence and spiritual incompatibility as the main reasons.
According to Akinwumi, his wife failed to take care of him when he was seriously ill, leading to a breakdown in their relationship. He stated that their marriage took a turn for the worse just a year after they got married, with continuous fighting due to a lack of love and affection. Despite efforts from Toyin’s relatives to help him start a transport business, Akinwumi felt that the marriage was no longer working and requested separation.
Akinwumi expressed his willingness to provide a monthly feeding allowance of N25,000 for their two children who were still living with their mother. However, Toyin opposed the separation, claiming that she still loved her husband and did not want the marriage to end. She mentioned that Akinwumi had abandoned them for almost a year, leaving her and the children in a difficult financial situation.
After hearing both parties, the presiding judge, Mrs. S.M. Akintayo, acknowledged the existence of a valid traditional marriage between Akinwumi and Toyin due to the payment of bride price. She noted that since Akinwumi expressed his lack of love for Toyin, there was little that could be done to salvage the marriage. As a result, Mrs. Akintayo granted the dissolution of the marriage and ordered both parties to maintain peace.
Additionally, the court issued a restraining order against Toyin to prevent her from harassing or interfering with Akinwumi’s personal life. This decision aimed to protect both parties and ensure a peaceful separation process.
Overall, the dissolution of John Akinwumi and Toyin’s marriage serves as a reminder of the complexities that can arise in relationships. Despite their differences, the court’s decision to grant a divorce allows both individuals to move forward and focus on their separate paths. It highlights the importance of addressing issues in relationships early on to prevent escalating conflicts and emotional distress for all parties involved.
