In Sierra Leone’s political landscape, there is a pressing issue that cannot be ignored – the refusal of the electoral commission to publish the results of the 2023 general and presidential elections. This defiance goes against democratic principles and transparency in governance, highlighting the need for accountability in the electoral process.
The Constitution of Sierra Leone, 1991, clearly outlines the mandates and guidelines that must be followed for a fair and credible electoral process. Section 32 Subsection (11) emphasizes the independence of the Electoral Commission and its authority to exercise its functions without interference. This includes the crucial task of publishing election results, a fundamental aspect of democratic governance.
The Public Elections Act, 2022 (PEA, 2022), further elaborates on electoral procedures and responsibilities. Sections 51, 52, and 93 of the PEA, 2022, specifically address the declaration, certification, and publication of election results, emphasizing the importance of transparency and prompt reporting.
Despite the legal framework in place, the failure to publish election results within the mandated timelines raises concerns about the legitimacy of the electoral process. It also creates a sense of mistrust among the public and undermines the credibility of election outcomes.
The repercussions of this failure extend beyond procedural matters and have the potential to impact the very fabric of democracy and the rule of law. The timely publication of election results is essential for ensuring a smooth transfer of power and upholding the integrity of democratic institutions.
Addressing the “elephant in the room” – the non-publication of election results – is crucial for restoring public trust in the electoral process. Transparency, accountability, and adherence to legal frameworks are essential for maintaining the stability and legitimacy of government institutions.
It is imperative to confront this issue head-on and uphold the principles of democratic governance. By shining a light on the challenges facing the electoral process in Sierra Leone, we can work towards a more transparent and responsible system that prioritizes the will of the people and ensures the integrity of democratic elections.
