Mauritius: On the sidelines of a stay of execution – SIM cards: protesters request an early hearing

Me Pazhany Rangasamy, a lawyer, has requested a Stay of Execution against the implementation of Regulations making it mandatory to re-register SIM cards, which was brought before Chief Justice Rehana Mungly-Gulbul during the Formal Matters Session of the Supreme Court yesterday.

Representatives of the State and the Minister of ICT, Deepak Balgobin, mentioned as defendants, informed the Court that they intend to submit their counter-affidavits in response to Me Pazhany Rangasamy’s affidavit. The representative of the Minister of ICT also stated that the Minister intends to request to be removed from this case. Me Rajesh Unnuth, a lawyer representing lawyer Pazhany Rangasamy, filed a motion for the Court to hear the arguments of the legal representatives in this case in March, despite the defendants’ counter-affidavits, considering the urgency of the situation as the deadline for SIM card holders to re-register them is fast approaching on April 30, 2024. However, the Chief Justice preferred for the defendants to submit their counter-affidavits before the Court hears the arguments of the legal representatives.

The case was therefore adjourned to Monday, March 11, when the defendants will submit their counter-affidavits.

At a press conference following the hearing, Me Unnuth emphasized that he does not intend to respond to the defendants’ counter-affidavits, and will ensure that the Court hears the arguments of the legal representatives as soon as possible. Me Sanjeev Teeluckdharry, on the other hand, reiterated a plea to Mauritians not to rush to re-register their SIM cards and to await the judgment of the Supreme Court.
