A 35-year-old man in Nairobi is facing charges of defilement, incest, and deliberate transmission of HIV after allegedly infecting his eight-year-old daughter. The suspect reportedly defiled the minor on multiple occasions between 2018 and 2019. Court documents identify the child as LAO and accuse the man of intentionally having unprotected sexual intercourse with her, knowing that he was infected with HIV, with the aim of transmitting the disease to her.
Additionally, the man is accused of committing an indecent act with the child during the same period and of engaging in incestuous sexual intercourse with her, knowing she was his daughter. The offenses are said to have taken place in Kingston slums within the Industrial Area in Nairobi, where he lived with the minor after separating from her mother.
The suspect is alleged to have started defiling the minor after his wife left, and the child’s mother had surrendered her to the suspect as her new husband did not want the child. It was later discovered that the child had been taken to her ex-husband’s rural home, where she lived with a relative.
When the mother noticed that the child was frequently falling ill, she took her to the hospital and discovered that she was HIV positive while the mother tested negative. The child then disclosed to medical professionals that her father had been defiling her before taking her to his rural home. The mother reported the matter to the police, and the suspect was eventually traced and arrested.
The accused denied all charges when arraigned at Makadara Law Courts and has been remanded in custody for medical tests needed as evidence in the case. The suspect will return to court after two days to set bail and bond terms and fix hearing dates.
