Police have opened another case for comedian and human rights activist Bon Kalindo, following the adjournment of the hearing for his bail application in a case related to his arrest on Tuesday. Kalindo was taken into custody on Tuesday for allegedly sharing material that could incite public alarm. The Principal Resident Magistrate Court in Lilongwe postponed his bail hearing, and shortly after, Investigator Innocent Kasambara informed the court that they were starting a new case against Kalindo.
Kasambara explained that the new case involves the illegal possession of a firearm, which they believe Kalindo acquired in 2021. The allegations suggest that Kalindo brought a gun to the Police Headquarters with the intention of obtaining a license. Despite the unfolding events, Kalindo remained composed during the proceedings.
Following this development, Kasambara requested the court to remand Kalindo for an additional five days to allow the State to conduct a thorough investigation into the matter. However, Kalindo’s lawyer, Khwima Mchizi, questioned Kasambara about the timeline of when the police became aware of the gun issue, pointing out that 2021 was quite a while ago. Kasambara evaded the question and instead emphasized that the police needed to determine how Kalindo procured the firearm.
In response, Mchizi and Kalindo’s other lawyer, Gilbert Khonyongwa, informed the court that Kalindo would exercise his right to remain silent on the issue. The Magistrate, Rodrick Michongwe, is expected to deliver a ruling on Kalindo’s bail application in the upcoming session.
The legal proceedings surrounding Kalindo have garnered significant attention, given his dual role as a comedian and human rights advocate. His arrest and subsequent charges have raised concerns about freedom of expression and selective law enforcement practices. As the case unfolds, Kalindo’s supporters and legal team are closely monitoring the developments to ensure his rights are protected.
Despite the challenges and uncertainties facing Kalindo, he has maintained his composure and continues to cooperate with the legal process. The accusations against him, particularly regarding the possession of a firearm, have added another layer of complexity to his legal predicament.
As the court deliberates on Kalindo’s bail application and the new case against him, the outcomes of these legal proceedings will have far-reaching implications for both the comedian and the broader human rights community in Malawi. The importance of upholding the rule of law and safeguarding the rights of individuals, regardless of their standing in society, remains paramount in ensuring justice and fairness for all.
