Chief Justice Rizine Mzikamanda has expressed concern over the prevalence of human trafficking in Malawi, labeling the country as the weakest link in the fight against Trafficking In Persons (TIP). Speaking in Lilongwe during a Validation Workshop of Trafficking in Persons Sentencing Guidelines, Mzikamanda highlighted the sophisticated nature of TIP cases, leading to an increase in such incidents. He emphasized the importance of the justice system’s response to this issue, stating that the Trafficking in Persons Act Sentencing Guidelines would provide direction for judges and magistrates when determining TIP sentences.
Mzikamanda stressed the necessity of thoroughly examining and evaluating the proposed sentences before their validation. High Court Judge Joseph Chigona echoed the sentiment, emphasizing the Judiciary’s crucial role in addressing trafficking issues. Chigona emphasized that only meaningful sentences could act as a deterrent to perpetrators, expressing hope that the process would also address the problem of delays in prosecuting TIP cases in the courts.
Principal Secretary for Homeland Security Steven Kayuni emphasized the need for a holistic approach to effectively combat and prevent human trafficking. He supported the implementation of guidelines to ensure appropriate sentences for suspects and enhance efficiency in delivering justice in the country.
In partnership with Plan International and the United States Department of State, Director for the Catholic Development Commission in Malawi Mandinda Zungu revealed their collaboration in consolidating and initiating the development of the guidelines. Mandinda emphasized the importance of periodically reviewing the guidelines to ensure they remain responsive to current trafficking trends on the ground.
Overall, the workshop highlighted the critical need for comprehensive guidelines and a coordinated approach to addressing human trafficking in Malawi. Participants recognized the importance of meaningful sentences in deterring perpetrators and enhancing the efficiency of justice delivery. By working together and regularly reviewing the guidelines, stakeholders aim to make significant progress in combating TIP and protecting vulnerable individuals in the country.
