From President of a special delegation (PDS), to mayoral candidate? It’s hard not to make the connection when reading one of the paragraphs of the new article 130 of the law on the resources of decentralized territorial collectivities (CTDs), on the modalities of elections, as well as on the organization, functioning, and attributions of their bodies.
This amendment, voted on by Parliament during the last extraordinary session, was validated by the High Constitutional Court (HCC) on Thursday. It is, in a way, the green light for the designation of the members of the special delegation for the CTDs that need it. The Urban Commune of Antananarivo (CUA) is at the top of the list. The main innovation brought by this article is found in its paragraph 4.
In essence, paragraph 4 allows members of a special delegation to be candidates in municipal elections, which was not allowed in the previous version of article 130. The new version of this provision provides that “the provisions of article 309 of the law 2014 – 020 (…) are applicable to members of the special delegation.” Article 309 concerns the imperatives that members of municipal or communal councils and mayors, whose candidacy in municipal elections is validated, must comply with.
“Municipal or communal council members and mayors and their deputies, who are candidates in municipal elections, are declared resigned automatically as soon as their candidacy has been deemed admissible (…) ,” provides article 309 of the law on the resources of CTDs. Returning to the case of CUA, the future PDS of Antananarivo and his deputies will therefore be able to run in the upcoming race for the mayorship of the capital and sit on its municipal council.
Each change brought by the new article 130 of the law on the resources of CTDs is clearly not random. Especially since the next step after the validation of these amendments is the designation of the members of the special delegation of Antananarivo, including its PDS. A strategic position in view of the upcoming municipal elections. It is certain that those in power want to keep the capital under the leadership of one of their own. It is likely that the next PDS will be the standard-bearer of the presidential camp in the municipal elections.
