The new penal code will be applied to rapes committed since February 26, 2024, according to the Republic’s prosecutor Narindra Navalona Rakotoniaina.

Johnny William Andrianambinintsoa, also known as Da-Willy, the alleged perpetrator of the rape of a girl in Imerintsiatosika, was arrested yesterday in Anosibe. He faces surgical castration.

His escape only lasted 24 hours. The alleged rapist of a six-year-old girl in Imerintsiatosika, Johnny William Andrianambinintsoa or Da-Willy, 23 years old, was picked up by the police early yesterday morning in Anosibe. He was peacefully sleeping in a taxi where he worked as an assistant driver.

He was questioned before being transferred to the prosecutor’s office today. He will, in principle, be placed in preventive detention according to the penal policy concerning rapes. A detention warrant is mandatory for any rapist as long as the charges are proven.

The date of his trial will be defined after his appearance before the prosecutor. If the court finds him guilty, he risks being the first rapist to undergo surgical castration as provided for in the new penal code. He would be the sole and unique perpetrator of the sexual assault on a six-year-old girl in Imerimandroso Imerintsiatosika.

“The revised law was promulgated on February 26, 2024. We received the official copy today (note: yesterday). Our criminal law has no retroactive effect. Therefore, it will only be applied to those who have committed a rape from the mentioned date,” asserts the Republic’s prosecutor Narindra Navalona Rakotoniaina, chief prosecutor at the Antananarivo first instance court.

According to her explanations, Da-Willy will soon face surgical castration. But until the day he appears in court, he will remain in prison.

The Minister of Population and Solidarities Haingo Elisette Fomendraza, shocked by Da-Willy’s crime, reiterated yesterday that there is no tolerance for rapists. According to her, this is the President’s own commitment in the fight against sexual violence.

Torn apart

The family and friends of Da-Willy admit to being particularly disappointed by his crime. It was on Sunday, late in the afternoon, that he allegedly abused the fatherless child after sending her to buy cigarettes for him.

The intimate part of the victim was severely torn. The local doctor examined her and then transferred her to the Joseph Ravoahangy Andrianavalona Hospital (HJRA) where she is currently being treated.

Her aggressor fled. Law enforcement intensified the search until reliable information reached them yesterday. He was apprehended by police officers from the fifth arrondissement.

Commissioner Lydie Rasoamanarivo, head of the central Police Morals and Child Protection department, stated that he will be brought before the prosecutor today.
