Seven ministers are running for the legislative elections. They must resign as soon as their candidacy is officially confirmed by the Independent National Electoral Commission.
Reshuffle or not? The question arises now that all candidates for the legislative elections have revealed themselves. Among them are seven ministers. Seven members of the government who will have to resign as soon as their candidacy is officially confirmed by the Independent National Electoral Commission (Ceni).
In its second paragraph, Article 64 of the Constitution provides that “any member of the government, a candidate for an elected office, must resign from his functions as soon as his candidacy is declared admissible”. According to the decree setting out the arrangements for the organization of legislative elections, the Ceni has until April 18, at the latest, to finalize the list of candidates selected in each electoral district.
This period takes into account the deadlines for appeals to the Electoral Commission first, and if necessary, to the High Constitutional Court (HCC). Aspiring deputies whose candidacies are rejected by the Verification and Registration Bodies (Ovec) can turn to the Ceni, and then to the HCC to plead their case.
The ministerial candidates, if selected, will have to resign from their positions as soon as the Ceni publishes the final list of candidates for deputies. There are seven in the race for the elections on May 29. There is Augustin Andriamananoro, Minister of Communication and Culture, a candidate in the 1st district of Antananarivo. Lalatiana Rakotondrazafy, Minister of Technical Education and Vocational Training, is a candidate in the Faratsiho district.
Interim
Justin Tokely, Minister of the Interior, is lining up in the Sambava district. Haingo Elisette Fomendraza, Minister of Population and Solidarity, is a candidate in Ambositra. André Haja Resampa, Minister of Youth and Sports, is also in the race in the Morondava constituency. Marie Michelle Sahondrarimalala, Minister of National Education, is a candidate in the Fianarantsoa I district.
Dr. Andriamanantena Razafiharison, Minister of Higher Education and Scientific Research, is a candidate in the Ampanihy district. Ministerial candidates will leave seven seats vacant in the government. Inside sources suggest that the “interim system” could be favored. However, the number of ministers called to resign points to the possibility of a reshuffle.
According to an informed source, the interim system will facilitate the reappointment of ministers. These ministers, whose political status will be further strengthened by the popular endorsement obtained in the legislative elections. For those who are not elected deputies, however, a double penalty can be expected. Furthermore, President Andry Rajoelina indicated during the government presentation in January that a reshuffle would take place after the legislative elections.
Republic practice dictates, moreover, that the Prime Minister submits the resignation of the government when a new majority is formed in the lower house. Article 54 of the Constitution states, in fact, that “the President of the Republic appoints the Prime Minister, presented by the majority party or group in the National Assembly.” The interim system could avoid the need for a government reshuffle twice in the span of about three months.
