Kenya: High Court Orders Athletics Kenya Officials Who Served Terms to Vacate Office

The High Court of Kenya issued a ruling on March 7, ordering the officials of Athletics Kenya, including President Jackson Tuwei, out of office. This decision came after the officials extended their tenure at the helm of the organization, with the judge noting that the president had been in power for eight years since the authority came into force in 2015.

The ruling stated that the officials and Executive Committee of Athletics Kenya who had served a cumulative period of 8 years since the Sports Act came into force must vacate office immediately. Additionally, the officials were declared ineligible to contest for any position within the organization in the future.

The ruling was made in response to a petition filed in court by athlete Moses Tanui and 9 other individuals who sought to have the officials declared illegally in office. The petition also included the Cabinet Secretary, Ministry of Sports, Culture and Arts, Registrar of Sports, Registrar of Societies, and the Attorney General as defendants. The athletes wanted the officials to be declared illegally in office, have all athletes become members of Athletics Kenya, and declare the organization’s constitution null and void.

The High Court judge ruled in favor of the petitioners, directing Athletics Kenya to carry out a further review of its constitution within the next 90 days to enhance inclusivity, democratic representation, and transparency in the organization. The judge also ordered each party in the petition to bear their individual costs.

In addition to his role as the President of Athletics Kenya, Jackson Tuwei was also elected as the World Athletics Vice President during the federation’s Congress in Budapest, Hungary, in 2023.

The ruling signified a significant change in the leadership of Athletics Kenya and highlighted the importance of transparency, inclusivity, and democratic representation within sports organizations. As the organization moves forward, it will be important for them to adhere to the court’s directives and ensure that athletes have a voice in the decision-making processes.
