The Attorney General and Minister of Justice (A-G), Mr Godfred Yeboah Dame, has advised President Nana Addo Dankwa Akufo-Addo to hold off on assenting to the Human Sexual and Family Values Bill, 2024 until the Supreme Court decides on two actions filed by Richard Dela Sky and Dr Amanda Odoi challenging its constitutionality and consistency with the 1992 Constitution.
In a letter dated March 18 and addressed to the Jubilee House, Mr Dame expressed his view that assenting to the bill while the applications for interlocutory injunction filed in the two suits are pending would render the applications unnecessary and undermine the authority of the Supreme Court to determine the issues raised. He emphasized the importance of allowing the Supreme Court to make a final determination on the actions due to the fundamental constitutional questions and public significance at stake.
The advice from the A-G comes following the submission of two suits by Mr Sky and Dr Odoi before and after the passage of the Human Sexual and Family Values Bill, 2024 by Parliament on February 28.
Mr Dame, as the government’s principal legal advisor, stressed the importance of upholding the rule of law and recommended that the decision to assent to the bill be deferred until the determination of the applications for interlocutory injunction.
In one of the suits, Mr Sky is seeking a declaration that the passage of the Human Sexual and Family Values Bill 2024 by Parliament contravened the Constitution based on several articles within the 1992 Constitution. He also challenges the role of the Speaker of Parliament in admitting and allowing the bill to proceed, alleging a contravention of specific articles.
