The Council of Ministers met in ordinary session on Wednesday, March 13, 2024, in its deliberation room at the Koulouba Palace, under the presidency of Colonel Assimi GOITA, President of the Transition, Head of State.

After examining the items on the agenda, the Council :

– adopted draft texts;

– made appointments;

– and heard communications.

LEGISLATIVE AND REGULATORY MEASURES
1. On the report of the Minister of Justice and Human Rights, Keeper of the Seals, the Council of Ministers adopted a draft decree fixing the composition of the Notaries’ costume. The notary is a public and ministerial officer appointed for life to ensure the public service of proof.

Due to their function, to distinguish them from ordinary citizens and to show the authority of their position, Ordinance No. 2013-027/P-RM of December 31, 2013 on the Status of Notaries provides that “notaries must wear, in official ceremonies, a costume whose composition is fixed by decree issued in Council of Ministers”.

It is in accordance with this provision that the draft decree is adopted.

  1. On the report of the Minister of Urban Planning, Housing, Domains, Territorial Planning, and Population, the Council of Ministers adopted a draft decree authorizing and declaring the public utility of works to convert the RR9 section into a 2×2 lane, the access ramp to Point G, 7 km of roads in Kati, and the GMS-Samé-Kati roundabout section.

This development project is part of the decongestion policy for the Bamako-Koulouba-Kati road, which aims to improve mobility and living conditions for the population.

The planned works encroach on private properties that need to be expropriated for public use in accordance with the provisions of land and property law.

The draft decree is adopted in this context.

COMMUNICATIONS
1. The Minister of State, Minister of Territorial Administration and Decentralization informed the Council of Ministers:

  1. of the dissolution of the association called “Association of Pupils and Students of Mali (AEEM)”.

The dissolution of associations by the Council of Ministers is provided for and regulated by the provisions of Law No. 04-038 of August 5, 2004 on associations.

The Association of Pupils and Students of Mali “AEEM” is a Malian legal association created following association declaration receipt No. 10281/MAT-DNAT of April 20, 1991.

For several years, it has been noted that the AEEM no longer defends the noble causes of pupils and students in accordance with its objectives. It has been accused several times of being responsible for violence and confrontations in the school and university environment, characterized by numerous armed clashes between the different factions of the association.

The latest clash occurred on February 28, 2024, resulting in the death of a young student from the Faculty of Economics and Management and several seriously injured individuals. These extremely serious acts occurred in the context of the renewal of the board of coordination of the Association of Pupils and Students of Mali and immediately led to the suspension of its activities in the university space until further notice.

Similar practices took place in December 2017 between rival factions of the AEEM committee of the Faculty of Science and Technology, resulting in one death. In October 2018, gun and machete fights between rival clans of the AEEM committee of the Faculty of Private Law resulted in nine (9) injuries, including two (2) serious ones.

Following each of these unfortunate events, security forces conducted surprise raids at the association’s headquarters, resulting in the arrest of some members found in possession of lethal weapons, drugs, and large sums of unexplained money.

These actions cause disturbances within the school and university environment and disrupt classes, leading to assassinations, murders, and destruction of public and private property through violent street demonstrations and illegal carrying of weapons.

In light of these findings, the Association of Pupils and Students of Mali “AEEM” is dissolved.

This dissolution contributes to the realization of one of the recommendations of the National Refoundation Conference: “To pacify the school and university space and make it a place for acquiring knowledge and skills, rather than vandalism and constant aggression”.

  1. of the revocation of the decrees appointing Special Advisors to the State Representatives and Decree No. 2017-0616/P-RM of July 28, 2017 establishing the remuneration of Special Advisors to the Regional Governors.

The Transitional Government, in its Communique No. 65 of January 25, 2024, declared the absolute inapplicability of the Peace and Reconciliation Agreement in Mali, arising from the Algiers process, and therefore announced its immediate termination.

This decision leads to the implementation of certain reforms, including:

  • – the replacement of Interim Authorities with Special Delegations;
  • – the revocation of the appointments of Special Advisors to the Governors of the Northern Regions

and consequently, the revocation of the decree establishing their remuneration.

  1. of the revocation of the decrees appointing members of the Interim Authorities and Transitional Colleges of the Region.

As part of the implementation of the Peace and Reconciliation Agreement in Mali, arising from the Algiers process, Interim Authorities and Transitional Colleges were established in 2016 in the Territorial Collectivities of Regions, Circles, and Communes of the Regions of Timbuktu, Gao, Kidal, Taoudeni, and Menaka.

The members of the Interim Authorities and Transitional Colleges of the Regions of Timbuktu, Gao, Kidal, Taoudeni, and Menaka were appointed in 2016.

As for the members of the Interim Community Authorities of the Regions of Taoudeni and Menaka were appointed by decrees and concern thirty (30) Communes of the Region of Taoudeni and twenty-one (21) Communes of the Region of Menaka.

The members of the Interim Authorities and Transitional Colleges consist of representatives of the Government, signatory groups of the Agreement (Platform, CMA), and Inclusivity.

These were confidence-building measures intended to contribute to the return of Administration and the provision of basic social services to the population.

Despite these efforts, nine (9) years later, shortcomings have been identified in the implementation of the Peace and Reconciliation Agreement in Mali, arising from the Algiers process, including the change in posture of some signatory Movement members who have become terrorist actors and are being pursued by Malian justice after committing and claiming terrorist acts. In these circumstances, some Presidents and members of the Interim Authorities and Transitional Colleges have abandoned their duties to join terrorist Movements and groups.

As a result, the decrees appointing members of the Interim Authorities and Transitional Colleges are revoked.

  1. The Minister of Foreign Affairs and International Cooperation informed the Council of Ministers:
  2. of the preparatory work for the 4th Türkiye-Mali Joint Trade and Economic Cooperation Commission.

The holding of the 4th session of the Türkiye-Mali Joint Trade and Economic Cooperation Commission is an opportunity to renew political dialogue, review economic, commercial, and technical cooperation offers based on common interests.

This session aims to elevate the partnership to the level of the strategic relations between our two countries. The objective is to invigorate, strengthen, and diversify our cooperation and identify new axes of cooperation.

  1. of the holding of the first session of the Grand Rwanda-Mali Joint Cooperation Commission in May 2024 in Kigali.

This first session offers the opportunity to strengthen the legal framework, review various areas of common interest, and establish cooperation programs to consolidate the strategic partnership between the two countries.

The holding of this first session is part of the materialization of the political will of the Highest Authorities of the two countries to further strengthen bilateral cooperation.

  1. The Minister of Higher Education and Scientific Research informed the Council of Ministers of the processing of study grants offered to the Republic of Mali by the Russian Federation for the academic year 2024-2025.
  • – for Bachelor’s studies, all baccalaureate series were merged, and the top 180 candidates were preselected;
  • – for Master’s studies, the top 80 candidates were preselected;
  • – for Doctorate studies, the top 30 candidates were preselected.
  1. The Minister of Health and Social Development informed the Council of Ministers:
  2. of Participation in the 11th African Conference on Sexual and Reproductive Health Rights in Morocco.

The Minister of Health and Social Development participated in the 11th African conference on sexual and reproductive health rights from February 28 to March 4, 2024.
The objective of this conference was to examine and expand progress on the status of women’s and young people’s sexual and reproductive health rights in Africa.
In addition to the meeting, the minister conducted a working visit to Moroccan social protection organizations to learn from their experience in managing the social protection system.

  1. of Participation in the Ministerial Conference on Malaria and the signing of the Commitment to Accelerate the Reduction of Malaria Mortality in Mali called “no one should die from malaria”.

The Minister of Health and Social Development participated in the conference of Health Ministers of countries with a “high burden high impact” of malaria in Yaoundé, Cameroon from March 5 to 7, 2024, to exchange and make commitments for accelerated reduction of malaria mortality in Africa.
The objectives of this meeting were:
– to review progress made and challenges to be overcome to achieve the malaria targets in the global technical strategy;
– to review mitigation strategies and financing for malaria control;
– to agree on effective strategies or aaccelerated reduction of malaria mortality in Africa;
– to establish a roadmap for increased political and social engagement in the fight against malaria, as well as a clearly defined accountability mechanism.
Following this meeting, the attending ministers signed the Yaoundé Declaration on fighting malaria.

  1. The Minister of Labor, Civil Service, and Social Dialogue informed the Council of Ministers of the process of organizing direct recruitment examinations in the State Civil Service for the year 2023.

Direct recruitment examinations for the State Civil Service for the budget year 2023 were canceled due to the discovery of a large-scale fraud network.
The new recruitment process will be launched through a statement by the Minister of Labor, Civil Service, and Social Dialogue on Friday, March 15, 2024.

  1. The Minister of Youth and Sports, responsible for Civic Education and Citizenship, informed the Council of Ministers:
  2. of the conclusions and recommendations of the national symposium on football.

The national symposium on Malian football was held from March 5 to 7, 2024 at the Stade du 26 mars in Bamako.
The meeting brought together representatives of the Republic’s institutions, technical services of the ministry, and stakeholders in Malian football, including the Malian Football Federation, sports journalists, former players, former sports ministers, national and international experts.
Following the discussions, the participants made recommendations including:
– operationalizing the FEMAFOOT National Technical Directorate;
– strengthening the technical staff with local technicians, an arbitration specialist, and doctors;
– continuing to equip the Sports Medicine Center;
– supervising and regulating football academies and centers;
– continuing to build sports infrastructure across the national territory;
– establishing U17 and U20 national championships for women;
– promoting national competitions;
– supervising supporters’ associations.

  1. of the organization of a Day of Appropriation of major State reforms by Youth.

The Day of Appropriation of major State reforms by Youth aims to create a space for dialogue and sharing that will allow participants to exchange views and take ownership of the major reforms currently underway as part of the refoundation.
It will take place on Saturday, March 16, 2024, in a participatory and interactive approach, structured around seven (07) themes.

  1. The Minister of Agriculture informed the Council of Ministers of the results of the pilot phase of the General Agricultural Census.

The pilot phase of the General Agricultural Census, which took place from February 17 to 28, 2024, covered seven (07) Regions through eight (08) Circles and eighteen (18) Communes.
It involved 126 agents and reached 13,408 people from 815 family farms. A total of 6,809 ha of agricultural plots were measured and geolocated. Concerning livestock, the counting test covered 27,405 cattle; 11,380 sheep; 8,439 goats; 6,736 native breed chickens.
This pilot phase aimed to test data collection tools and methodology, estimate data collection time, and evaluate the workload of enumerators.

  1. The Minister of National Entrepreneurship, Employment, and Vocational Training informed the Council of Ministers:
  2. of the process of developing a national Entrepreneurship Strategy.

The Ministry of National Entrepreneurship, Employment, and Vocational Training has been engaged since November 2023 in developing a national Entrepreneurship Strategy.
The development process has been very inclusive and has involved many stakeholders, such as public authorities, the private sector, civil society, and technical and financial partners.
The strategy project is articulated around six (06) strategic axes that translate into twenty-one (21) specific objectives.

  1. of the organization of an information and awareness campaign on youth entrepreneurship in school and university environments.

The launch of the campaign took place on February 26, 2024 at the Faculty of Economics and Management. It is part of the implementation of the Youth Employment Program.
This year, the campaign will reach over 3,000 young students and students through 20 sessions held in schools and universities.
The aim is to raise awareness and inform students about the programs put in place by the Youth Employment Promotion Agency for financing young people’s projects.

  1. The Minister of Industry and Commerce informed the Council of Ministers of the main conclusions of the 13th Ministerial Conference of the World Trade Organization.

The thirteenth Ministerial Conference of the World Trade Organization took place from February 26 to March 1, 2024 in Abu Dhabi, United Arab Emirates.
The conference addressed topics related to subsidies to Fisheries, agriculture, Dispute Settlement, electronic commerce, Investment Facilitation for Development, and Trade, Inclusivity and Sustainable Development.
The Ministerial Conference was capped by the Abu Dhabi Declaration and the adoption of ministerial decisions:
– on the reform of the Dispute Settlement rules;
– on the precise, effective, and operational implementation of the special and differentiated provisions of the Sanitary and Phytosanitary Measures Agreement and the Technical Barriers to Trade Agreement;
– on support measures for the smooth transition of countries leaving the Least Developed Country category;
– on the Small Economies Work Program;
– on the e-commerce work program;
– on the non-violation of the Agreement on Trade-Related Aspects of Intellectual Property Rights.
In the context of negotiations on Agriculture and Cotton, Mali takes on the presidency of the C-4 and Ivory Coast for a period of two years.

  1. The Minister Delegate to the Prime Minister, in charge of Political and Institutional Reforms, informed the Council of Ministers of the conclusions of the high-level workshop on the theme “Executive Power in the Constitution: Interactions with other Powers, Values, and Principles”.
