For the 2015 MINSEP – FECAFOOT agreement, firstly, the provision is for state officials. It is not for contracting a non-member of the civil service.
Secondly, the appointment process must always start with the proposal from the technical body, which is the federation sending it to its supervisory authority. The Ministry of Sports cannot replace the technical body by making its own proposals to the top. It has supplanted the federation in its role.
Simply put, for there to be a contract, the President of FECAFOOT must intervene. For the provision, we do not need his agreement because the State draws from its own internal resources to do so. In this case, there is no contract.
